Landlord and tenant deals with two main areas, namely commercial leasing of a premises and the renting of private dwelling house.
We will advise on the contents of a Lease, whether a long term lease or a short term lease. We will further advise in respect of rent review clauses, repair obligations, rights to a new lease (if any), insurance obligations, termination of the lease.
For the landlord we will draft an appropriate Lease according to their instructions and specific requirements and ensure their interest is protected.
For the tenant we will negotiate the best terms possible for them, we will explain the covenants and conditions they are obliged to adhere too. We will also advise on any Stamp Duty that may be payable.
This area of law is governed by the Residential Tenancies Act 2004 which mostly came into effect on the 1st September 2004. The Act also saw the establishment of the Private Residential Tenancies Board (PRTB). The Act requires all tenancies to be registered by the landlord with the PRTB which allows both the tenant and landlord to refer all disputes to them in order to have them resolved.
